Judgment Collection & Enforcement
A favorable court judgment isn’t the end — it’s the beginning of recovery. We pursue unpaid rent, damages, and applicable court fees aggressively and lawfully through proceedings supplemental, wage garnishments, bank account levies, and other enforcement tools. Our goal is to turn your judgment into effective monetary collection.
Collecting on the Court Judgment
You’ve been successfully guided by Adler Law LLC during the bifurcated eviction process – Now it’s time for us to help you recover what you’re owed by leveraging Indiana law to your advantage. While there is a legal obligation for the debtor to pay, Indiana courts
do not automatically collect the debt on your behalf. It’s up to you to initiate post-judgment collection efforts.
How Adler Law LLC Assists You in Collecting
We support the collections process after bifurcated eviction proceedings, where possession and damages are determined separately. Our team works quickly to convert that judgment into monetary collection. If a tenant has income or assets, we’ll find the most efficient way to collect. We work to locate employment and banking information through discovery, subpoenas, and third-party interrogatories. When necessary, we pursue contempt actions for noncompliance with court orders.
Adler Law LLC leverages Indiana law to assist landlords and property owners in collecting on unpaid judgments:
- Proceedings Supplemental – Summons debtor to court to disclose assets and income
- Wage Garnishment – Up to 25% of disposable earnings can be garnished directly from paychecks
- Bank Garnishment – Seize funds from the debtor’s bank account via court order
- Liens and Attachments – Place liens on real estate or seize personal property
- Contempt Actions – Pursue legal consequences if the debtor refuses to comply with court orders
As previously mentioned, many landlords are unaware that they must actively pursue collection after a judgment is entered. Even fewer know how to file proceedings supplemental or draft interrogatories to third parties. At Adler Law, we handle all the post-judgment enforcement and ensure everything is done lawfully and efficiently. This includes:
- Drafting and filing proceedings supplemental
- Preparing and serving interrogatories
- Garnishment orders
- Settlement negotiations and payment plans
Don’t settle for just getting the property back. If a tenant left behind damage, unpaid rent, or a mess, you deserve compensation. A court judgment is enforceable for up to 10 years in Indiana, and it can be renewed before expiration. The sooner you begin collection efforts, the more likely you are to financially recover.
Contact Adler Law LLC to schedule a consultation and turn your judgement into real dollars. We are skilled and ready to guide you through the process so you can collect on the judgments and close the case for good.
